These Terms of Service ("Terms") govern your use of the CodePath Australia Pty Ltd ("CodePath", "we", "our", or "us") website, learning platform, and educational programs. By accessing our website or enrolling in any of our programs, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Acceptance of Terms

By accessing or using our website, creating an account, or enrolling in a CodePath program, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Refund Policy.

If you do not agree to these Terms, you must not access or use our services. If you are enrolling on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

You must be at least 18 years of age to enrol in a CodePath program. By enrolling, you confirm that you meet this age requirement.

2. Enrolment & Payment

Enrolment in a CodePath program is subject to availability and any applicable admissions criteria. We reserve the right to decline an application at our discretion.

Tuition and Fees

Program fees are listed on the relevant course page and are quoted in Australian Dollars (AUD), inclusive of GST where applicable. We reserve the right to update pricing for future cohorts; however, your tuition is locked at the rate quoted at the time of your enrolment.

Our refund terms are detailed in our Refund Policy. By enrolling, you acknowledge and agree to the refund terms outlined therein.

3. Student Responsibilities

As a CodePath student, you are expected to uphold the following responsibilities:

Attendance

Students must maintain a minimum attendance rate of 90% across all scheduled sessions, including lectures, workshops, and mentoring calls. If you are unable to attend a session, you must notify your cohort lead at least 24 hours in advance. Consistent failure to meet the attendance requirement may result in removal from the program without eligibility for the Job Guarantee.

Assignments and Coursework

Students must complete and submit all assignments by their due dates. Late submissions may be accepted at the discretion of your instructor, but habitual late submissions may affect your standing in the program and eligibility for the Job Guarantee.

All students are expected to maintain a professional and respectful learning environment. The following behaviours are prohibited and may result in immediate dismissal:

4. Intellectual Property

Course Materials

All course materials, including but not limited to lecture slides, video recordings, code examples, exercises, assessments, and supplementary resources, are the intellectual property of CodePath Australia Pty Ltd and are protected by Australian and international copyright laws.

Students are granted a limited, non-exclusive, non-transferable licence to access and use course materials for personal educational purposes only. You may not reproduce, distribute, modify, publicly display, or create derivative works from any course materials without prior written consent from CodePath.

Student Projects

Projects, code, and other original works created by students during the program remain the intellectual property of the respective student. CodePath does not claim ownership over student-created work. However, by participating in the program, you grant CodePath a non-exclusive, royalty-free licence to use your project for promotional purposes (such as showcasing on our website or social media), unless you opt out in writing.

5. Job Guarantee Terms

CodePath offers a Job Guarantee for eligible programs. To qualify, you must meet all of the following criteria:

A "qualifying role" is defined as a full-time or permanent part-time position (minimum 30 hours per week) in a field directly related to your program of study, with an annual salary of at least $50,000 AUD. Contract and freelance arrangements of equivalent value may also qualify at CodePath's discretion.

6. Limitation of Liability

To the maximum extent permitted by law, CodePath Australia Pty Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to:

Our total aggregate liability to you for any claim arising from these Terms or our services shall not exceed the total fees you have paid to CodePath in the 12 months preceding the claim. Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under Australian Consumer Law.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales. Before commencing legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation and, if necessary, mediation.

We reserve the right to modify these Terms at any time. When we make material changes, we will:
